These Terms and Conditions ("Terms") govern all photography, videography, floor plan, 3D tour, virtual staging, drone, and related real estate media services provided by IM Real Estate Media ("IM Real Estate Media," "we," "us," or "our").
By booking, ordering, purchasing, or using services from IM Real Estate Media, the individual or entity placing the order ("Client") acknowledges that they have read, understood, and agreed to these Terms.
IM Real Estate Media provides real estate media services that may include, but are not limited to:
Available services, pricing, deliverables, and turnaround times may vary and are subject to change.
The specific services included in an order are determined by the services and add-ons selected by the Client at the time of booking.
Appointments are subject to availability and are not guaranteed until the booking has been accepted or confirmed by IM Real Estate Media.
The Client is responsible for providing accurate property information, contact information, access instructions, requested services, and any other information reasonably necessary to complete the appointment.
The Client does not need to be present during the appointment provided that IM Real Estate Media has been given appropriate authorization and access to the property.
If access cannot be obtained at the scheduled appointment time, additional fees may apply if the appointment must be delayed, rescheduled, or repeated.
By booking services, the Client represents that they have the authority to authorize IM Real Estate Media and its contractors or representatives to enter and photograph, record, scan, or otherwise capture the property.
The Client is responsible for arranging property access before the scheduled appointment, including lockbox information, gate codes, keys, occupant coordination, or other necessary access arrangements.
IM Real Estate Media is not responsible for delays or incomplete services caused by inaccessible rooms, locked areas, unavailable amenities, occupants, contractors, pets, vehicles, or other access restrictions.
Properties should be clean, staged, and photo-ready before the scheduled appointment.
The Client, property owner, occupants, or their representatives are responsible for preparing the property before IM Real Estate Media arrives. This includes, where applicable, cleaning the property, decluttering, making beds, preparing landscaping, removing or concealing personal items, moving vehicles, securing pets, and completing other preparations necessary for photography or media capture.
IM Real Estate Media may make minor adjustments when reasonably practical, such as straightening pillows, moving small distracting items, turning lights on or off, opening blinds, or making similar minor changes. However, IM Real Estate Media is not responsible for cleaning, staging, organizing, moving furniture, or performing extensive property preparation.
If the property is not adequately prepared, IM Real Estate Media may photograph the property in its existing condition or, when necessary, delay or reschedule the appointment. Additional fees may apply for a return visit or rescheduled appointment.
IM Real Estate Media is not responsible for unwanted objects, clutter, property conditions, or other visible items appearing in the final media when those items were present at the time of capture.
Pets should be secured before the appointment unless otherwise agreed.
The Client is responsible for ensuring that occupants, children, pets, contractors, and other individuals at the property do not interfere with the safe and efficient completion of the services.
IM Real Estate Media is not responsible for supervising pets, children, occupants, contractors, or other persons present at the property.
Clients should provide as much notice as reasonably possible when cancelling or rescheduling an appointment.
A $50 cancellation or rescheduling fee may apply to appointments cancelled or rescheduled without sufficient notice, after travel to the property has begun, or when an appointment cannot be completed because of circumstances within the Client's control.
IM Real Estate Media may waive cancellation or rescheduling fees at its discretion, including in circumstances involving severe weather, emergencies, unsafe conditions, or other reasonable situations.
Certain services depend on weather, lighting, visibility, wind, air quality, and other environmental conditions.
IM Real Estate Media may recommend or require that an appointment or portion of an appointment be rescheduled when conditions would significantly affect quality or safety.
Unless the appointment is rescheduled, the Client acknowledges that weather and environmental conditions present at the time of capture may appear in the delivered media.
Current pricing is based on the services, packages, and add-ons selected at the time of booking.
Unless otherwise arranged, payment is required according to the payment terms displayed during booking or assigned to the Client's account.
Depending on the Client's approved payment arrangement, payment may be required before order submission, before media download, or through an approved weekly or monthly invoicing arrangement.
Brokerages, companies, teams, or other approved accounts may be eligible for separate invoicing arrangements.
Invoices are due according to the payment terms stated on the invoice.
IM Real Estate Media reserves the right to withhold delivery, download access, licensing rights, or future services when an account has an outstanding balance.
Additional services requested after the original booking may result in additional charges.
Standard pricing applies within IM Real Estate Media's normal service area.
Properties outside the standard service area may be subject to additional travel charges. Any applicable travel charge should be disclosed during booking or communicated to the Client before the appointment whenever reasonably possible.
Estimated turnaround times may be displayed when booking or communicated separately for individual services.
Turnaround times are estimates unless IM Real Estate Media expressly agrees in writing to a specific delivery deadline.
Delivery may be delayed by unusually large projects, editing requirements, third-party processing, technical problems, internet or hosting outages, emergencies, or other circumstances outside the reasonable control of IM Real Estate Media.
The number of photographs, video duration, or other deliverables associated with a package represents the deliverables included with that service.
Not every photograph or video clip captured during an appointment will be delivered.
IM Real Estate Media retains discretion over image selection, composition, camera placement, editing, sequencing, and other creative decisions necessary to produce the final deliverables.
Duplicate images, test shots, missed-focus images, unusable exposures, setup footage, redundant compositions, and other files that IM Real Estate Media determines are unsuitable for final delivery may be excluded.
The Client acknowledges that photography and videography involve artistic and professional judgment.
IM Real Estate Media retains reasonable creative discretion regarding composition, lighting, exposure, color, cropping, image selection, editing, HDR processing, sky replacement, video sequencing, stabilization, music selection where applicable, and overall presentation.
Reasonable efforts will be made to represent the property accurately while producing visually appealing marketing media.
If delivered media contains a technical or editing error attributable to IM Real Estate Media, the Client should contact us as soon as reasonably possible so the issue can be reviewed.
Reasonable corrections for legitimate processing or editing errors may be made at no additional charge.
Requests involving creative preference changes, substantial retouching, object removal, additional editing, re-editing previously approved media, or work outside the originally purchased service may be subject to additional fees.
IM Real Estate Media is not a permanent file-storage or archival service. Clients are responsible for downloading and securely backing up all delivered media.
RAW photographs, unedited video footage, and other original or working files are not included with standard delivery.
IM Real Estate Media makes no guarantee that RAW photographs, unedited video footage, project files, or other working files will be retained after final media has been delivered. These files may be permanently deleted at any time following delivery without notice.
If a Client requires RAW photographs, unedited video footage, or other original files, the Client must request them before final media is delivered.
Requests for RAW or unedited files are subject to approval by IM Real Estate Media and may be subject to an additional fee. Any agreed-upon RAW or unedited file delivery should be confirmed before completion of the project.
Final edited JPEG photographs will be retained by IM Real Estate Media for one (1) year from the date of delivery.
After the one-year retention period, the files may be permanently deleted without notice and their continued availability is not guaranteed.
Unless expressly stated otherwise, final videos, source video files, floor plans, virtual staging files, 3D tour assets, and other deliverables are not guaranteed to be archived for any particular period.
The Client is responsible for maintaining their own copies and backups of all delivered media. IM Real Estate Media is not responsible for replacing files after the applicable retention period or for RAW, unedited, or working files that have been deleted following delivery.
Unless otherwise agreed in writing, all photographs, videos, and other copyrightable media created by IM Real Estate Media remain the intellectual property of IM Real Estate Media.
Payment for services does not constitute a transfer or sale of copyright.
The Client receives a license to use the delivered media as provided in these Terms.
Upon payment in full, the Client is granted a non-exclusive license to use the delivered media for marketing and promoting the property for which the media was commissioned.
Permitted uses may include:
The license does not transfer copyright ownership to the Client.
The Client may not sell, sublicense, transfer, or provide the delivered media to unrelated third parties for their independent commercial use unless authorized by IM Real Estate Media.
Builders, developers, architects, interior designers, stagers, contractors, property managers, publications, subsequent listing agents, or other businesses wishing to use the media may be required to obtain separate permission or licensing from IM Real Estate Media.
Providing media to an MLS or property-marketing platform as necessary to market the commissioned listing is permitted under the Client's license.
Unless otherwise agreed in writing, IM Real Estate Media may use media it creates for its own portfolio, website, social media accounts, advertising, promotional materials, demonstrations, competitions, educational materials, and other business-marketing purposes.
Clients with privacy, security, confidentiality, or other concerns should notify IM Real Estate Media before the appointment or before publication of the media.
Virtual staging, virtual twilight photography, object removal, sky replacement, and other digitally altered media may change the appearance of a property beyond what was physically present at the time of capture.
The Client is responsible for determining whether digitally altered media must be identified or disclosed under applicable MLS rules, advertising requirements, brokerage policies, platform policies, or other requirements applicable to the Client.
Virtual staging and digitally altered media should not be used to intentionally misrepresent material characteristics of a property.
Floor plans, room measurements, square-footage estimates, and similar products provided by IM Real Estate Media are intended primarily for marketing and informational purposes.
Measurements and floor plans are approximate and should not be relied upon as architectural plans, surveys, appraisals, inspections, engineering documents, or official determinations of property boundaries or legally recognized square footage.
Clients, buyers, sellers, and other parties should independently verify measurements or property information when accuracy is material to a transaction or decision.
Certain services may rely on third-party platforms or providers, including services such as Zillow 3D Home, Matterport, hosting providers, processing providers, or similar services.
Availability, processing, hosting duration, features, compatibility, and continued operation of third-party services may be governed by the applicable provider and may be outside the control of IM Real Estate Media.
IM Real Estate Media is not responsible for third-party platform outages, policy changes, discontinued services, changes in functionality, or other circumstances outside our reasonable control.
Drone photography and videography are subject to applicable aviation laws, airspace restrictions, authorization requirements, weather conditions, property conditions, safety considerations, and operational limitations.
IM Real Estate Media may delay, modify, decline, or reschedule drone operations when conditions are unsafe, unlawful, or otherwise unsuitable for flight.
The Client acknowledges that ordering drone services does not guarantee that every requested aerial photograph, angle, altitude, flight path, or video sequence can legally or safely be captured.
IM Real Estate Media provides visual marketing services and does not perform property inspections, surveys, appraisals, title searches, measurements for legal purposes, or verification of property disclosures.
IM Real Estate Media does not independently verify property boundaries, lot size, square footage, room dimensions, amenities, construction quality, permits, zoning, property condition, or representations made by sellers, agents, owners, or other parties.
The Client remains responsible for the accuracy of listing information and property representations used in marketing.
IM Real Estate Media reserves the right to refuse, suspend, or discontinue services when conditions present a reasonable safety concern or prevent the services from being performed lawfully or appropriately.
Examples may include aggressive animals, unsafe structures, hazardous materials, dangerous weather, threatening individuals, unsafe drone conditions, inaccessible areas, or other hazardous circumstances.
Where practical, IM Real Estate Media will work with the Client to determine whether the affected services can be rescheduled or completed under safer conditions.
The Client is responsible for:
If a reshoot is necessary because of an error attributable to IM Real Estate Media, we may provide an appropriate reshoot or correction without additional charge.
Reshoots resulting from circumstances outside our control may be subject to additional charges.
Examples include changes made to the property after the original appointment, property preparation issues, inaccessible rooms or amenities, vehicles or contractors obstructing areas, weather changes requested by the Client, staging changes, landscaping changes, construction completion, or Client preference changes.
To the fullest extent permitted by applicable law, IM Real Estate Media will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the services, delayed delivery, unavailable media, third-party services, or use of delivered media.
IM Real Estate Media is not responsible for losses relating to delayed listings, lost sales, lost commissions, lost marketing opportunities, MLS issues, third-party platform failures, or similar consequential losses.
To the fullest extent permitted by applicable law, the total liability of IM Real Estate Media arising from a particular order or service will not exceed the amount actually paid by the Client to IM Real Estate Media for the specific order giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by law, the Client agrees to indemnify and hold harmless IM Real Estate Media from third-party claims, damages, liabilities, or reasonable expenses arising from the Client's unauthorized use of delivered media, lack of authority to grant property access, violation of third-party rights, inaccurate information supplied by the Client, or use of the media in violation of applicable law, MLS rules, brokerage requirements, or platform policies.
IM Real Estate Media will not be responsible for delays or failure to perform caused by circumstances reasonably outside its control, including severe weather, natural disasters, wildfire, power or internet outages, equipment failure despite reasonable precautions, illness or emergency, government restrictions, road closures, third-party service interruptions, or similar events.
When reasonably possible, affected services will be rescheduled or alternative arrangements will be discussed with the Client.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any rights or remedies available to consumers under applicable law are not waived where such rights cannot legally be waived.
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
These Terms, together with the Client's order, invoice, booking confirmation, and any written agreement specifically applicable to the services purchased, constitute the agreement between the Client and IM Real Estate Media regarding those services.
If a separately signed written agreement expressly conflicts with these Terms, the separately signed agreement will control with respect to that conflict.
IM Real Estate Media may update these Terms from time to time.
The Terms applicable to a particular order will generally be the version in effect at the time the order is placed, unless otherwise agreed or required by law.
The effective date displayed at the top of this page indicates when these Terms were most recently updated.
